On Again, Off Again; Another Stay Stalls BG&E Rate Cut

LCG, July 24, 2000--Maryland's Circuit Court for Baltimore City on Friday issued an interim two-week stay preventing Baltimore Gas & Electric Co. from putting into effect its customer choice program for electricity users and from granting its customers a 6.5 percent rate cut.

Christian H. Poindexter, chief executive of Constellation Energy Group, the holding company for BG&E, termed the stay "a temporary setback for 1.1 million Baltimore Gas & Electric customers."

It was the latest in a series of temporary setbacks engineered by a New Jersey-based group claiming to represent out-of-state electricity marketers seeking to sell power to residential customers in Maryland. The organization, Mid-Atlantic Power Supply Association (Mapsa) says BG&E rigged the calculation so that its standard offer price is so low it can't be competed with.

In his order Friday, Judge Albert J. Matricciani said "it is not the intention of this Court to indicate in any manner its judgment with respect to the merits of Mapsa's request for a stay..." He scheduled a hearing for August 4 on the stay.

It wasn't the first time that a stay had been granted on Mapsa's petition. Poindexter noted that "Mapsa's stay request has been considered by the courts four times and, after appropriate consideration, ultimately denied each time."

BG&E said that when Mapsa runs out of venues in which to plead its case, it will make the 6.5 percent rate cut retroactive to July 1, when customers of other Maryland utilities got theirs.
