FERC Nominee Approved by Senate Committee

LCG, Mar. 12, 2003--A nominee for a seat on the Federal Energy Regulatory Commission (FERC) who has been a senior policy advsier to Energy Secretary Spencer Abraham was approved by members of the U.S. Senate Energy and Natural Resources Committee by a 17-2 vote.

Joseph Kelliher, a Republican, would fill an open seat on the commission, having been nominated previously by President Bush in May of last year without action from the Senate. Kelliher's nomination will next be considered by the full Senate. Sen. Pete Domenici, R-N.M., who recently became chairman of the Energy and Natural Resources committee, has stated that he wants the process of consideration for another, Democratic nominee, Suedeen Kelly, to be completed quickly.

Kelliher would fill the third of three seats held by Republicans, while Kelly would succeed William Massey, whose term is due to expire on June 30. The other Democratic seat is now vacant. Kelly, who was nominated by President Bush Monday, would be the first of the recent commissioners with a background in Western energy issues. "The West and FERC haven't really been talking to each other," Beth Emergy, an energy lawyer who has worked with Kelly, told Dow JOnes Newswires. "She'll be a great person to get the dialogue back."

FERC Chairman Pat Wood III has said that he wants outstanding issues and complaints connected with the Western energy crisis from 2000-2001 to be decided upon by March 26. While Kelly will almost certainly not be on the commission by then, the FERC is likely to issue rulings that include standards for gas-price indexes and more substantial detail surrounding price reporting.
