Bush Would Use Eminent Domain to Get Transmission Corridors

LCG, May 9, 2001The Bush administration plans to ask Congress for authority to use the power of eminent domain to establish electric power transmission corridors in the U.S., government officials said yesterday.

The Federal Energy Regulatory Commission already can use eminent domain for the siting of natural gas pipelines, but has no such authority when it comes to electricity transmission lines. As it is, power companies seeking to build a transmission line must get permission from states, counties, cities, townships, water districts, farm bureaus and many other local jurisdictions.

When a pipeline is completed, the land looks just like it did before it was built, but transmission corridors represent a clear-cut swath through forests and towers visible for miles in open land. Moreover, lots of people believe repeatedly disproved contentions that power lines cause cancer in people living near them.

Transmission constraints have been cited as a major bottleneck in the national and regional power grids and the cause of power shortages in some areas. In California, a short segment of the state grid in the Central Valley the now-infamous "Path 15" makes it difficult to move power from Southern California and Arizona into Northern California.

Talking to CNN yesterday, Vice President Dick Cheney said "The issue is whether or not we should have the same authority on electrical transmission lines " as we have on natural gas pipelines. He said the matter would be addressed in his energy task force report which will be released next week.
