Shareholders File Suit Against El Paso Electric

LCG, January 21, 2003-A lawsuit was filed in U.S. District Court for the Western District of Texas against El Paso Electric regarding alleged violation of federal laws.

The lawsuit, on behalf of shareholders and filed by a shareholder owning 100 common shares, addresses allegations that El Paso Electric Company did not comply with federal securities laws.

El Paso Electric is not related to the El Paso Corporation, a large energy and natural gas pipeline company also undergoing legal scrutiny.

The Form 8-K was filed today with the Securities and Exchange Commission. The lawsuit comes as the Federal Energy Regulatory Commission is investigating improper behavior in the Western electricity market.

Little information is available regarding the suit, but El Paso Electric denies any wrongdoing.

El Paso Electric distributes and generates electricity in West Texas and New Mexico. The company serves over 300,000 customers.
