CFTC Issues Subpoena for Energy Bids

LCG, Apr. 23, 2003--Bids made by Reliant Resources Inc. through the California Independent System Operator (ISO) in the summer of 2000 are being sought by the Commodities Futures Trading Commission (CFTC), which issued a subpoena to the grid operator.

The ISO released a notice to market participants yesterday that included the subpoena, and stated that it plans to provide the CFTC with the bid data from the requested period, June 18 through June 25, 2000. The federal agency said it wishes to obtain arrangements between Reliant and the ISO for out-of-market sales, and day-ahead, hour-ahead, and real-time market bids.

Although the CFTC lacks the power of prosecution, it has met with representatives of the U.S. Attorney's office in houston, which has charged El Paso Corp. and Dynegy Inc. in cases of alleged reporting of fabricated trades. The ISO will provide the information outlined in the subpoena on May 1, the market notice said.
